Uma análise social, jurídica e jurisprudencial da adoção por casais homoafetivos no Brasil: uma mutação constitucional

Abstract

The research problem to be presented consists of: researching on homoaffective adoption, where an article will be presented that shows the reality of homoaffective couples, their struggles to achieve recognition of their rights, an analysis of the LGBTQIA+ movement and its achievements will be made, observing the treatment given by societies, since the beginning of time to those who love others of the same sex, so that we can understand how it reflects the issues related to civil, political, social and human rights of this target audience, and absorb the various cultural heritages which make up society and its diversity. The general objective is to research about the same-sex union and its role in society. As a specific objective, research will be carried out on adoption by homoaffective couples in its causes and consequences, its evolution, the adoption process, the difficulties, the prejudice of conquests, such as social security law, the positioning of family law in the face of these changes, especially after the recognition of the stable union. by the STF and in view of the guarantee of the right of abandoned children to family life, love, education and dignity, finally, I will present an on-site survey carried out with the social worker in which she presented me with the step-by-step procedure for adopting a child according to the guidelines of the ECA (Statute of Children and Adolescents.
