JUSTIÇA RESTAURATIVA COMO UMA ALTERNATIVA AO SISTEMA PENAL

Abstract

Considering that Restorative Justice exists as an alternative to humanize traditional systems, this study will deal with the implementation of Restorative Justice as an innovative and effective alternative to the traditional Brazilian criminal system. The traditional criminal system focuses on punishment and deprivation of freedom of the offender, restorative justice emerges seeking to restore damaged relationships, thus focusing on holding the offender accountable to the victim and the community, thus seeking the reintegration of the offender into society and worrying about with the well-being of the victim. In order to investigate the effectiveness of restorative justice, the study will examine everything from the theoretical foundation of restorative justice to its application in different legal contexts, so that its effectiveness and the benefits that the implementation of this approach brings to society can be demonstrated, such as the reduction of recidivism, victim satisfaction, among others. Through a critical analysis, the article will also address the challenges and limitations of restorative justice, thus seeking to contribute to the debate on the implementation of a more humanized system within the traditional justice system.
