JUSTIÇA CRIMINAL BRASILEIRA: ANÁLISE DA JUSTIÇA RESTAURATIVA COMO INSTRUMENTO DE MELHORIA SISTEMÁTICA

Abstract

The Brazilian Criminal Justice System is analyzed, both in terms of public security and the prison system, investigating whether Restorative Justice is capable of enabling improvements. For this, the hypothetical-deductive research method is used, having a theoretical type of research, through a bibliographic review. Furthermore, it is presented, as a representative result, that restorative practices enable the resocializing function of punishment, forgotten by traditional criminal procedural channels. Furthermore, it appears that the penalties applied in Brazil, including the custodial sentence, have not been sufficient for the State to control crime. Furthermore, there are limits to the application of Restorative Justice, as it depends on the voluntariness of the parties, among other factors. The contributions of this research, therefore, consist of revealing the criminal panorama in Brazil and the possible impacts of Restorative Justice. Keywords: Criminal Justice. Public security.
