UMA ANÁLISE SOBRE O CRIME DE DESACATO E O DIREITO À LIBERDADE DE EXPRESSÃO NO SISTEMA INTERAMERICANO DE PROTEÇÃO AOS DIREITOS HUMANOS

Abstract

The objective is to analyze the compatibility of the crime of contempt (Article 13 of the Brazilian Penal Code) from the perspective of the Inter-American System for the Protection of Human Rights, in particular Article 13 of the American Convention on Human Rights, which shows the general contours of the right to freedom expression in the member countries of the Organization of American States. It uses the exploratory and descriptive method, literature review and the inductive method. In the end, it concludes on the unconventionality of the aforementioned crime due to the illegitimate restrictions it entails on freedom of expression.
