Resumo:	O estudo constitui em uma análise em formato de artigo sobre decisões do Tribunal de Justiça do MS acerca dos recursos nas ações contra planos de saúde, com uma breve explicação sobre tutela provisória e a escassez do direito fundamental à saúde
Abstract:	This study aims to analyze provisional relief decisions in lawsuits against health insurances of the Court of Justice of Mato Grosso do Sul, seeking to understand its effectiveness and impact on the protection of consumer rights. The research method used was through jurisprudence, bibliographical research and the study of concrete cases. Based on the information obtained, a reflection was carried out on the resistance of health insurances to the fulfillment of contractual obligations, the importance of provisional relief as a legal institute and respect for the hierarchy of a system with justices of different degrees.
