O direito fundamental à liberdade religiosa e os símbolos religiosos

Abstract

Este trabalho tem por objetivo analisar o direito fundamental à liberdade religiosa e sua referência à apreciação axiológica com postulados de matriz judaico-cristã. Na perspectiva constitucional, tem-se como fio condutor a primeira parte do art. 5º, inc.VI, da Constituição Federal de 1988, em que “é inviolável a liberdade de consciência e de crença, sendo assegurado o livre exercício dos cultos religiosos”. A delimitação do campo de análise especifica-se, no tocante à doutrina, na contextualização histórica do fenômeno religioso, pautada em Machado (1996) e Adragão (2002), e na consequente construção da liberdade religiosa; no histórico das constituições brasileiras e no tratamento jurídico-constitucional dispensado ao direito à liberdade religiosa. Também se evoca a teoria dos direitos fundamentais de Alexy (2011) e a concepção contemporânea do direito à liberdade religiosa, no âmbito do Direito Internacional dos Direitos Humanos, segundo a visão de Piovesan (2014), pela perspectiva do direito comparado, com especial ênfase no estudo de casos: crucifixos e véu islâmico em espaços públicos. No que concerne à proposta metodológica, assenta-se em Durkheim (1996), para quem os símbolos são instrumentos por excelência da integração social. No cenário assim articulado, verifica-se que a liberdade religiosa é uma espécie do gênero liberdade de expressão ancorada no princípio da dignidade da pessoa humana, que se constitui como regra norteadora do ordenamento jurídico e elemento unificador dos direitos fundamentais. Nesse segmento, recorre-se a Canotilho (2003), que reconhece a emergência dos direitos fundamentais numa sociedade com crescente complexidade sistêmica dentro de um modelo de Estado Constitucional Cooperativo. Considerados os princípios teórico-metodológicos adotados e a temática em foco, esta pesquisa enfatiza procedimentos pertinentes à pesquisa exploratória, de natureza qualitativa, priorizando a busca, em fontes bibliográficas, do maior número de informações, considerando, para tanto, a perspectiva temporal diacrônica.

ABSTRACT - This work aims to analyze the fundamental right to religious freedom and its reference to the axiological appreciation with postulates of Judeo-Christian matrix. In the constitutional perspective, it has as a guideline the first part of art. 5th, inc.VI, of the Federal Constitution of 1988 in which "is inviolable the freedom of conscience and religion, being guaranteed the free exercise of religious cult". The delimitation of the field of analysis it is stated, with regard to the doctrine, on the historical contextualization of the religious phenomenon, based on Machado (1996) and Adragão (2002), and in the consequent construction of religious freedom; in the history of Brazilian constitutions and in the legal and constitutional treatment of the right to religious freedom. Also evokes the theory of fundamental rights of Alexy (2011) and the contemporary conception of the right to religious freedom, under the International human rights law, according to the vision of Piovesan (2014), by the perspective of comparative law, with special emphasis on case studies: crucifixes and Islamic veil in public spaces. Concerning to the methodological approach, rests on Durkheim (1996), for whom the symbols are the instruments par excellence of social integration. In the so articulated scenario, it turns out that religious freedom is a species of the genus freedom of expression anchored in the principle of human dignity, which is constituted as a guiding rule of law and unifying element of fundamental rights. In this segment, we resort to Canotilho (2003), which recognizes the emergence of fundamental rights in a society with increasing systemic complexity within a model of Cooperative Constitutional State. Considering the theoretical and methodological principles adopted and the thematic in focus, this research emphasizes relevant procedures to exploratory research, of qualitative nature, prioritizing the search in bibliographic sources, the largest amount of information, considering, therefore, the diachronic temporal perspective.
