A INSUFICIÊNCIA DO ECA DIANTE DA SITUAÇÃO PECULIAR DAS CRIANÇAS ÓRFÃS POR FEMINICÍDIO: UM ESTUDO A PARTIR DA REALIDADE

Abstract

This study begins with the observation that, although the Brazilian legal system recognizes the comprehensive protection of children and adolescents as an absolute priority, there are weaknesses in the effective implementation of these rights, especially in contexts of social vulnerability. The research aims to analyze the limits and challenges of the Statute of Children and Adolescents in the face of specific realities, with emphasis on children rendered invisible by complex situations, such as orphanhood resulting from femicide. It is justified by the need to understand how the system of guaranteeing rights responds—or fails to respond—to the demands of these individuals. To this end, bibliographic and documentary sources were used, with a qualitative and critical-analytical approach, seeking to identify gaps between the norm and practice. The method adopted consisted of a literature review and interpretative analysis of recent studies on the subject. The results point to a mismatch between legal provisions and their implementation, highlighting the need to strengthen public policies and coordination among the responsible bodies. It is concluded that the effective implementation of comprehensive protection requires not only the existence of norms, but also the construction of more sensitive, continuous strategies aligned with the specificities of the different forms of child vulnerability.
