POLÍTICA MIGRATÓRIA BRASILEIRA: A BUSCA PELA EFETIVAÇÃO DOS DIREITOS FUNDAMENTAIS DE IMIGRANTES E REFUGIADOS NO BRASIL

Abstract

The present study analyzes Brazilian migration policy from the perspective of the realization of the fundamental rights of immigrants and refugees. The research contextualizes the process of formation and transformation of migration policies in Brazil, highlighting the need to ensure access to basic documentation, education, and health as essential conditions for the exercise of citizenship. The study is justified by the social and legal relevance of the topic, given the increasing migratory flow and the challenges faced in promoting the inclusion of these populations. The main objective is to understand how the Brazilian State has effectively guaranteed, in practice, the fundamental rights established in national legislation and international human rights treaties. A deductive methodology is adopted, based on bibliographical review and documentary analysis of legal norms, public policies, and institutional data. It is concluded that, despite normative advances, bureaucratic, institutional, and linguistic barriers persist, limiting the full social integration of migrants and refugees and demanding stronger action from public authorities.
