A REFORMA DO MILITAR ESTADUAL DE MATO GROSSO DO SUL NÃO ESTÁVEL EM VIRTUDE DE ACIDENTE EM SERVIÇO

Abstract

The present work proposes an analysis of legislative omission in relation to the retirement of students undergoing military training in the State of Mato Grosso do Sul, comparing it with other military forces. In a brief explanation, it will presents the process of entering the State military career, the fundamental principles that it consists in and the Military Law. Furthermore, the study will seek to clarify the distinctions between retirement types and define the concept of injuries in the military context. In the end, an analysis will be carried out of the Complementary Law of Mato Grosso do Sul that regulates the State military forces in comparison with other forces that address the same institute, in this case, the retirement of the student in the training course, in light of the Symmetry Principle. The objective is also to demonstrate the legal decisions of the country's highest courts related to this issue, highlighting the relevant parts and the gaps in State laws in comparison with federal regulations and those of other states.
