“HOME OFFICE” E TELETRABALHO: O DIREITO À PROTEÇÃO DA SAÚDE DO TRABALHADOR.

Abstract

The purpose of this work is to study the impacts of teleworking and working from home on workers' health. To this end, it initially studies the history of telecommunications, with an understanding of the arrival and development of the internet in Brazil, then, going through the concept and legal nature of teleworking, arriving at the home office modality, also discussed in this work. Regarding methodological procedures, a bibliographical research was carried out using the hypothetical-deductive method. The fundamental bases of Constitutional Law, Labor Law and Environmental Law structure the protection of the work environment, which must be healthy and balanced, for the execution of teleworking and home office activities, so that the company fulfills its obligation to preserve the dignity of the worker in its entirety. Therefore, consider that, in addition to observing the right to disconnect, the main challenges in question can be overcome through the regulation of specific laws and public policies for worker health.
