UMA ANÁLISE DO DOLO EVENTUAL E DA CULPA CONSCIENTE NO PROCESSO-CRIME DA BOATE KISS

Abstract

The tragedy that occurred at the Kiss Nightclub on January 27, 2013, in the city of Santa Maria, Rio Grande do Sul, shook the Brazilian nation and raised complex issues in the field of criminal law. The fire that resulted in 242 fatalities brought to light crucial issues related to willful misconduct and conscious guilt, legal concepts that played a central role in the unfolding of the subsequent judicial process. . The general objective of this article is to carry out a critical and in-depth analysis of the role of eventual intent and conscious guilt in the judicial process of Kiss Nightclub, aiming to contribute to the understanding of these concepts in the context of the Brazilian criminal justice system and to promote relevant discussions on legal accountability in cases of similar disasters. To achieve the objectives of this study, abroad and thorough bibliographic research was conducted. Therefore, as a final consideration, the analysis of the eventual intent and conscious guilt in the intimacy of the Kiss Nightclub process is not only a reflection on the legal implications, but also a blunt reminder of the need to prioritize public safety and the prevention of similar tragedies. It is imperative that society and the authorities learn from this tragedy so that lives are not lost in vain in the future. The memory of the victims must be honored with actions that ensure that events as tragic as this never occur again in our country.
