TRANSIÇÃO ENERGÉTICA JUSTA E DIREITOS FUNDAMENTAIS: CAMINHOS PARA O DESENVOLVIMENTO SUSTENTÁVEL

Abstract

The Just Energy Transition (JET) is configured as a complex challenge of the 21st century, anchored in the imperatives of Constitutional Law and social justice. The central problem lies in how the JET can reconcile the migration to a low-carbon matrix with the realization of fundamental rights and the implementation of Sustainable Development Goals 7, 10, and 16 in Brazil, mitigating energy poverty and deepening energy democracy. The work is justified by the need to overcome the technocratic view of the transition, applying the Energy Justice tool to analyze the gaps in distribution, recognition, and procedural aspects within the current regulatory frameworks. The objective is to demonstrate that the success of an inclusive JET depends on being guided by justice and equality. The work uses the deductive method with a qualitative approach, through bibliographic and documentary research. It concludes that access to energy assumes the status of a fundamental norm, indispensable for dignified housing and human dignity, requiring the State to implement robust socio-energy policies, such as the restructured “Luz para Todos” and the “Tarifa Social de Energia Elétrica”, ensuring that energy is a vector for development and not social exclusion.
