ACESSO À JUSTIÇA, ENQUANTO INSTRUMENTO DE EFETIVAÇÃO DE DIREITOS FUNDAMENTAIS, NO ÂMBITO DA COMUNIDADES RIBEIRINHAS NO PANTANAL/MS

Abstract

This work analyzes the challenges faced by the riverside population of Corumbá-MS in accessing justice, since this is one of the main instruments for the realization of fundamental rights. The research methodologies used in this article were the dialectical method and field research, with the objective of discussing and arguing, as well as observing and understanding the challenges that the riverside dwellers of Corumbá-MS face in accessing justice, bringing provocations on the subject and experiences lived by this student while a volunteer intern at the Federal Public Defender's Office (DPU), in an expedition carried out in the Alto Pantanal region, with the purpose of bringing legal services to the riverside dwellers, in the year 2025. The research problem addresses how the difficult location in which riverside communities find themselves, coupled with the lack of effective public measures, presents significant challenges to their access to justice as an instrument for the realization of their fundamental rights. The main characteristics of the riverside communities of Corumbá-MS were presented, along with the concept of the right to access justice, the importance of the Itinerant River Court of the Federal Regional Court of the 3rd Region as a means of access to justice, and the lack of other effective measures for access to justice for riverside communities. This research highlighted the problems faced by the riverside communities of Corumbá-MS in accessing justice as an instrument for the realization of fundamental rights.
