Abstract

ABSTRACT: This paper focuses on the legal protection of obstetric violence in Mato Grosso do Sul. The research is qualitative and bibliographical, focusing on the relevant legislation and judgments of the Court of Justice of Mato Grosso do Sul. The research focuses on the legal challenges that exist in the effective application of the federal and state regulatory framework in the protection against obstetric violence and its general objective is to analyze the cases submitted to the Court of Justice of Mato Grosso do Sul (TJMS) from 2018 to 2025, with research using the keywords “violence”, “obstetric” and “accountability”. Its specific objective is to survey the legal frameworks in force in Mato Grosso do Sul and identify characterization parameters, legal grounds and forms of accountability, in order to understand the judicial action of Mato Grosso do Sul in the face of this problem.
