Abstract

The issue of the Democratic State of Law related to the Welfare State is extremely important, it deals with fundamental issues for the political and social organization of a nation. The general objective of this theme is to analyze the relationship between the Democratic State of Law and the Welfare State and its contribution to the promotion of social justice and the well-being of the population, and the specific objectives are to analyze the principles and foundations of the Democratic State of Law and the Welfare State; identify the challenges faced in the implementation of the Welfare State in several countries, including Brazil, in recent years and describe the relationship between the Welfare State and democracy in Brazil, considering the evolution of public policies and changes in legislation related to the subject since the promulgation of the 1988 Constitution. The methodology of this study consisted of a literature review with a search for articles in national journals, books and monographs published in Portuguese available in Google Scholar (Google Scholar) and Scielo (Scientific Electronic Library Online), the search was carried out from 2018 to 2023. In conclusion, the Democratic State of Law and the Welfare State are underlying concepts for the promotion of social well-being and the guarantee of the underlying rights of citizens, however, the implementation of these concepts faces several challenges, such as the issue of financial sustainability, the need to ensure the effectiveness of public policies and overcoming political and ideological resistance.
