dc.description.abstractThe present study aims to analyze, among the various consequences arising from genderbased violence, the right to advancement to the positions of ministers in higher courts and the barriers faced by female legal professionals. In this way, based on the glass ceiling theory, the right of access and the reasons for the low number of women occupying the most esteemed positions within the Judiciary will be addressed. The method used in this work was hypothetical-deductive, with the research being carried out in a bibliographical way, with data collection available on the websites of the Superior Courts analyzed in a qualitative way. In this sense, it could be observed that the occupation of positions within the Superior Courts is disparate when a comparison is made between genders, with the participation of women being considered negligible. With this, it is understood that the need to break down barriers in relation to the patriarchal structure still present in the Judiciary and the search for changes regarding the way the Courts are composed, this change being essential so that there is greater female representation within of Superior bodies, given that there is full qualification of women for positions.-

dc.description.resumoO presente estudo tem como objetivo analisar, dentre as diversas consequências advindas da violência de gênero, o direito à ascensão aos cargos de ministras dos tribunais superiores e às barreiras enfrentadas pelas profissionais do direito do sexo feminino. Dessa forma, é abordado, com base na teoria do teto de vidro, o direito de acesso e as razões do baixo número de mulheres ocupando os cargos de maior estima dentro do Poder Judiciário. O método utilizado neste trabalho foi o hipotético-dedutivo, tendo a pesquisa se dado de forma bibliográfica, com coleta de dados disponíveis nos sites dos Tribunais Superiores analisados de forma qualitativa. Nesse sentido, pôde ser observado que é díspar a ocupação dos cargos dentro dos Tribunais Superiores quando feita uma comparação entre os gêneros, podendo ser considerada ínfima a participação das mulheres. Com isso, entende-se que pela necessidade da quebra de barreiras em relação à estrutura patriarcal ainda presente no Poder Judiciário e a busca por mudanças no que tange a maneira que se compõem os Tribunais, sendo essa mudança essencial para que haja maior representatividade feminina dentro dos órgãos Superiores, tendo em vista que há plena qualificação das mulheres para os cargos.pt_BR
