dc.description.abstractDescribing the legalization of such historical achievements is the primary objective of this work. To this end, we sought to carry out a brief survey of the laws that guide the formal guarantee to indigenous school education in the country. The research was carried out from a bibliographic and documentary review on the topic. In addition to the normative description, the article aims to stimulate academic debate regarding the complexity of the relationship between social rights and inequalities in the country, in order to understand not only the formalization of such rights in the constitutional and infralegal scope, but also the need for effective substantiation the right to indigenous school education in the country. To this end, the constitutional changes present in the Federal Constitution of 1967, in the Amendment of 1969, in the Federal Constitution of 1988, as well as in the Statute of the Indian of 1973 will be observed.-

dc.description.resumoDescrever o marco legal e as conquistas históricas sobre a educação escolar indígena.é o objetivo primordial deste trabalho. Para tanto, buscou-se realizar um breve levantamento das legislações que norteiam a garantia formal à educação escolar indígena no país. A pesquisa foi realizada a partir de uma revisão bibliográfica e documental sobre o tema. Além da descrição normativa, o artigo pretende estimular o debate acadêmico relativo à complexidade da relação entre direitos e desigualdades sociais no país, de forma a compreender não somente a formalização de tais direitos no âmbito constitucional e infralegal, como também, a necessidade da substantivação efetiva do direito à educação escolar indígena no país. Para tanto, serão observadas as mudanças constitucionais presentes na Constituição Federal de 1967, na Emenda de 1969, na Constituição Federal de 1988, bem como, no Estatuto do Índio, de 1973.pt_BR
