ABANDONO AFETIVO E DIGNIDADE HUMANA: PERSPECTIVAS JURÍDICAS PARA REPARAÇÃO DO DANO

Abstract

The work studies the reality of affective abandonment, the problems it causes and its forms of reparation, in the face of the fundamental principle of human dignity, which guides the entire Federal Constitution of 1988. influence a person in all aspects of his life. The lack of this affection leads us to affective abandonment, what are its consequences and forms of reparation, in view of the Civil Code of 2002. It brings to the discussion how far these legal reparations, often in an indemnity way, are capable of solving the conflict, since we are dealing with something much more personal than cool. It is concluded, the importance of affection in family relationships, and the consequences of the lack of it in the development of the person, discussing here, ways of repairing this damage caused, in ways that are really effective for those who were abandoned. The methodologies used in this work were based on bibliographic research, followed by ExPost Facto research and finally, participatory research.
