O PAPEL DO DIREITO À MEMÓRIA E DA LITERATURA NA PRESERVAÇÃO DO ESTADO DEMOCRÁTICO DE DIREITO: UMA ANÁLISE A PARTIR DA OBRA MEMÓRIAS DO CÁRCERE DE GRACILIANO RAMOS

Abstract

This work analyzes the right to memory and truth as foundations of the Democratic Rule of Law, using Graciliano Ramos's work, "Memories of Prison," as an interpretive framework. It seeks to understand how the preservation of collective memory and the recognition of historical truth contribute to the consolidation of democracy and the realization of human rights in Brazil. The research stems from the observation that institutional forgetting and historical denial represent threats to democracy, making the strengthening of collective memory indispensable. The choice of topic is justified by the need to reflect on the role of literature as an instrument of resistance and preservation of truth, especially in periods of authoritarianism and censorship. The work adopts a qualitative methodology and a deductive approach, based on bibliographic and documentary review, articulating legal and literary analysis. It concludes that the right to memory and truth constitutes an ethical and legal duty of the State and society, and that literature is a legitimate means of preserving truth and strengthening democracy.
